These Terms of Use (the “Terms”) govern access to and use of the RPG Habit application (the “Service” or the “App”). By creating an account or using the Service, you accept these Terms without reservation. If you do not accept these Terms, you must not use the Service.
1. Interpretation
In these Terms, capitalized words have the meaning given to them in Section 2, whether used in the singular or the plural.
2. Definitions
- Application / Service: the RPG Habit mobile application, including this website.
- We, Us, Our, Publisher: the publisher of RPG Habit.
- You, User: any person who accesses or uses the Service.
- Account: the personal space created when you register.
- User Content: any nickname, message or content you post via the social features (chat, guild).
3. Purpose and acceptance of these Terms
RPG Habit is a gamified habit-tracking app that turns your everyday habits into a role-playing (RPG) experience: earning experience points, character progression, quests, gear collection, and challenges. Using the Service implies full and unconditional acceptance of these Terms. We encourage you to review them regularly, as they may be amended in accordance with Section 19.
4. Creating and managing your Account
To access certain features, you must create an Account. You agree to provide accurate information when registering and to keep it up to date.
You are solely responsible for keeping your login credentials confidential and for all activity carried out from your Account. You must notify us without delay of any unauthorized use of your Account or any breach of its security, at the address given in Section 21.
Use of the Service is reserved for people aged at least 16, or who have the consent of their legal guardian if they are a minor. Since the social features (guild, chat) involve exchanges with other users, we encourage the legal guardians of minor users to familiarize themselves with these features and to supervise their use.
5. Content and intellectual property
All elements of the Service — text, images, quests, progression systems, graphics, trademarks and logos — are the exclusive property of RPG Habit or its licensors, and are protected by intellectual property law.
We grant you a personal, non-exclusive, non-transferable and revocable right to use the Service for strictly personal, non-commercial purposes. You are not permitted to copy, reproduce, modify, distribute, decompile or extract all or part of the Service’s content without our prior written authorization.
6. User conduct
By using RPG Habit, you agree not to:
- Share illegal, offensive, defamatory or misleading content;
- Impersonate a third party or attempt to access other users’ accounts;
- Disrupt, overload or compromise the operation, security or integrity of the Service (introducing viruses, exploiting vulnerabilities, etc.);
- Use bots, scripts or any other automated means to access the Service or extract data from it;
- Decompile, disassemble or attempt to extract the App’s source code, except where expressly permitted by law;
- Use the Service for commercial purposes without our prior authorization;
- Within community spaces (chat, guild, messaging): harass, threaten, insult or intimidate another user, post sexual, discriminatory or hateful content, send unsolicited commercial or advertising messages (spam), or solicit personal information from another user, particularly a minor.
Any breach of these rules may result in the suspension or deletion of your Account, without notice or compensation.
7. Social features (Guild, Chat) and User Content
RPG Habit offers community features such as guilds and a chat system, allowing users to interact with each other. By using these features, you agree that:
- Your nickname, level, progress and the messages you post are visible to the other members of your guild or the discussion spaces you take part in;
- You remain solely responsible for the User Content you post, and you grant us a non-exclusive right to display it, store it and, if necessary, keep it for moderation purposes or as evidence in the event of a report;
- We may, without notice, moderate, hide or remove any User Content, and suspend, remove from a guild, or ban any Account that does not comply with the conduct rules set out in Section 6;
- You can block or report another user from within the App; blocking prevents future exchanges without notifying the blocked user.
We do not guarantee real-time monitoring of all exchanges. We act as soon as reasonably possible upon a report or upon becoming aware of unlawful content.
8. Reporting and moderation
If you witness or experience inappropriate behavior, unlawful content or abuse in the chat or a guild, you can report it directly from the App using the report feature, or write to us at the address given in Section 21.
After reviewing a report, we may take any action we deem appropriate, including removing the content in question, temporarily or permanently restricting access to social features, or suspending the Account of the user concerned, without notice or compensation.
9. Links to other websites
The Service may contain links to third-party sites or services (app stores, social networks) that are neither owned nor controlled by RPG Habit. We assume no responsibility for the content, privacy policies or practices of such third-party sites, and encourage you to review them before use.
10. Disclaimer regarding content and tracked habits
Please read this section carefully.
RPG Habit provides gamified habit-tracking tools for informational and entertainment purposes, designed to help you stay motivated day to day. This content does not constitute medical, psychological, financial or professional advice, nor a diagnosis or prescription of any kind.
If the habits you choose to track relate to your health, physical activity, sleep, diet or any other sensitive area, we recommend consulting a qualified professional before making any significant change, particularly if you have a pre-existing condition or any doubt about your ability to do so.
You acknowledge that you use the Service and track the habits of your choice at your own sole risk. To the extent permitted by applicable law, RPG Habit shall not be liable for any direct or indirect consequences resulting from tracking a habit through the Service. This limitation does not exclude our liability in the event of gross or intentional misconduct, or in cases where applicable law prohibits such an exclusion.
11. Availability of the Service
We strive to keep the Service accessible, without guaranteeing continuous, uninterrupted availability. The Service may be temporarily suspended for maintenance, updates, or reasons beyond our control (outages, force majeure, failure of a third-party provider such as our hosting service). We reserve the right to modify, suspend or discontinue all or part of the Service at any time, with or without notice, without this giving rise to any compensation.
12. “AS IS” warranty and limitation of liability
The Service is provided “as is” and “as available”, without warranty of any kind, express or implied, including as to its reliability, accuracy or freedom from error. To the extent permitted by applicable law, RPG Habit disclaims all liability for indirect or incidental damages, or for loss of data, profits or opportunities resulting from use of, or inability to use, the Service.
User Content posted in chat or guilds is produced by users themselves and is not reviewed by RPG Habit before publication. We are not liable for content posted by a third-party user, but we commit to acting promptly to remove any clearly unlawful content we become aware of, in particular through the reporting mechanism described in Section 8.
Nothing in these Terms excludes or limits any rights that are mandatorily guaranteed to you under the law applicable in your country of residence, in particular regarding consumer protection.
13. Termination
You may stop using the Service and request deletion of your Account at any time (see our Privacy Policy). We reserve the right to suspend or terminate your access to the Service, at our sole discretion and without notice, in the event of a breach of these Terms.
14. Personal data
The processing of your personal data is described in our Privacy Policy, which forms an integral part of these Terms.
15. Dispute resolution
In the event of a disagreement relating to the Service or these Terms, we invite you to contact us first at the address given in Section 21 to seek an amicable solution. Failing an amicable resolution within a reasonable time, the dispute may be brought before the competent courts in accordance with Section 20.
16. Users located in the European Union
If you reside in the European Union, you benefit from the mandatory consumer-protection provisions applicable in your country of residence, which these Terms cannot override. In the event of a conflict between a clause of these Terms and such mandatory provisions, the latter shall prevail.
17. Severability
If any clause of these Terms is found to be invalid or unenforceable by a competent court, that clause shall be amended and interpreted to best achieve the objectives of the original clause, to the extent permitted by applicable law. The remaining clauses of these Terms shall remain in full force and effect.
18. Waiver
Our failure to exercise, or delay in exercising, any right or provision of these Terms shall not constitute a waiver of that right or provision.
19. Changes to these Terms
We reserve the right to modify these Terms at any time, in particular to comply with any legal, regulatory or technical developments. In the event of a material change, you will be notified via a notification within the App or by any other appropriate means, at least 30 days before it takes effect where reasonably possible. Continued use of the Service after such changes are published constitutes acceptance of them.
20. Governing law
These Terms are governed by French law. Subject to the mandatory consumer-protection provisions applicable in your country of residence (see Section 16), any dispute relating to their interpretation or performance falls under the jurisdiction of the French courts, absent a prior amicable resolution.
